By downloading, installing, or using Gold Bullion Stacker ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a legally binding agreement between you and Gold Bullion Stacker ("we," "us," or "our").
These Terms incorporate Apple's standard Licensed Application End User License Agreement (EULA) available at apple.com/legal/…/stdeula. In the event of a conflict between Apple's EULA and these Terms, Apple's EULA shall govern.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple device that you own or control, solely for your personal, non-commercial purposes and as permitted by the App Store Terms of Service.
You may not: (a) copy, modify, or distribute the App; (b) reverse engineer or attempt to extract the source code; (c) sublicense, sell, or transfer the App; (d) use the App for any illegal purpose; (e) circumvent or disable any security features; or (f) use the App in any way that could damage or impair our services.
Free Tier. The App is free to download and includes delayed price data and basic portfolio features as described on our website.
Pro Subscription. Gold Bullion Stacker Pro is available as a monthly or annual auto-renewing subscription. Subscription fees are charged to your Apple ID account at the time of purchase and upon each renewal period. You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
No Refunds. All purchases are final and non-refundable except as required by applicable law or Apple's refund policies. Requests for refunds must be made directly to Apple via reportaproblem.apple.com.
Price Changes. We reserve the right to change subscription pricing. We will notify you in advance of any price changes and give you the opportunity to cancel before the new price takes effect.
Free Trials. If a free trial is offered, it will begin immediately upon subscription. Unused portions of a trial are forfeited upon purchase of a subscription.
The App provides spot price data, market indicators, dealer pricing comparisons, and portfolio tracking tools for informational purposes only. Specifically:
We are not a registered investment advisor, broker-dealer, or financial institution. Use of the App does not create any financial advisory relationship.
Any data you enter into the App (holdings, notes, purchase prices) remains your own. You grant us a limited license to store and process this data solely to provide the App's features to you. You are responsible for the accuracy of data you enter. We are not liable for decisions made based on inaccurate user-entered data.
The App may display links to third-party bullion dealers and websites. These links are provided for convenience only. We do not endorse, monitor, or have control over third-party websites or their content. We are not affiliated with or sponsored by any specific bullion dealer unless explicitly stated.
The App, including all content, design, code, trademarks, and logos, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
You agree to indemnify and hold us harmless from any claims, damages, losses, and costs (including legal fees) arising from your violation of these Terms or your use of the App.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the American Arbitration Association's rules, except that either party may seek injunctive relief in court for intellectual property matters. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may suspend or terminate your access to the App at any time for violation of these Terms. You may terminate your use by deleting the App. Sections 4, 7, 8, 9, 10, and 11 survive termination.
We may update these Terms from time to time. We will notify you of material changes via push notification or in-app notice. Your continued use of the App after the effective date of changes constitutes acceptance of the new Terms.
